These Terms of Service (“Terms”) govern your access to and use of thalamusbills.com and the Thalamus legislative intelligence platform (collectively, the “Service”), operated by Thalamus LLC (“Thalamus,” “we,” or “us”). By accessing the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and able to enter into a binding contract under the laws of your jurisdiction. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. What Thalamus is
Thalamus aggregates, analyzes, and presents legislative information sourced from public records, primarily the Oregon Legislature. Capabilities include bill tracking, hearing transcripts, AI-assisted analysis, client workspaces, and document generation. The Service is provided for informational purposes for government affairs professionals, in-house counsel, advocacy organizations, and state agencies.
3. AI-generated content disclaimer
Thalamus uses generative AI models to summarize bills, analyze legislator behavior, draft documents, and answer questions about legislative activity. AI-generated content may contain errors, omissions, or misinterpretations. Thalamus output is informational only and is not legal, lobbying, compliance, or professional advice. You are solely responsible for verifying any AI-generated content before relying on it for professional, regulatory, or strategic decisions.
4. Accounts
Some features require an account. You agree to provide accurate registration information, keep your credentials confidential, and notify us promptly at sales@thalamusbills.com of any unauthorized access. You are responsible for all activity under your account.
5. Acceptable use
You agree not to:
- Use the Service to violate any law or third-party right.
- Resell, sublicense, or otherwise commercially redistribute the Service or its output without our written permission.
- Scrape, crawl, or otherwise extract data from the Service at a rate or scale that interferes with normal operation.
- Reverse-engineer, decompile, or attempt to discover the source code or underlying ideas of the Service, except to the extent applicable law expressly permits.
- Upload, transmit, or generate content that is unlawful, defamatory, harassing, or infringing.
- Use the Service to compete with Thalamus or to build a competing product.
6. Your content
You retain ownership of any content you upload to Thalamus (“Customer Content”) — client documents, configuration, notes, reports. You grant Thalamus a worldwide, non-exclusive, royalty-free license to host, process, and display Customer Content solely to provide the Service to you. We will not use Customer Content to train any generally-available AI model.
7. Our content
Thalamus, its design, software, AI prompts, generated analysis, and all related intellectual property are owned by us or our licensors. Nothing in these Terms grants you ownership of any of it. Where Thalamus output is generated from public records (such as Oregon Legislature data), the underlying records remain public; the synthesis, analysis, and presentation are ours.
8. Fees
The marketing site is free to browse. Pricing for the Thalamus platform is presented during onboarding and detailed in any order form, statement of work, or pricing page applicable to your account. New professional accounts may be offered an initial trial period at our discretion. Any fees are non-refundable except as required by law or expressly stated in a written agreement.
9. Service availability
We strive to keep Thalamus available, but the Service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted availability, freedom from errors, or specific outcomes. Scheduled maintenance, third-party outages, and force majeure events may interrupt access.
10. Privacy
Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
11. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THALAMUS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We make no representation that AI-generated analysis is accurate, complete, or suitable for any particular legal, lobbying, or regulatory purpose.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THALAMUS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS, WHICHEVER IS GREATER.
13. Indemnification
You agree to indemnify and hold Thalamus harmless from any claim, loss, or expense arising out of your breach of these Terms, your Customer Content, or your unlawful use of the Service.
14. Termination
We may suspend or terminate your access to the Service at any time for material breach of these Terms or for any other reason on reasonable notice. You may stop using the Service at any time. On termination, the provisions of these Terms that by their nature survive (including Sections 6, 7, 11, 12, 13, and 16) will continue in effect.
15. Changes to the Terms
We may update these Terms from time to time. Material changes will be reflected in the “Last updated” date and, for account holders, communicated by email. Continued use of the Service after a change constitutes acceptance of the updated Terms.
16. Governing law and disputes
These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Marion County, Oregon, and you consent to the personal jurisdiction of those courts.
